Five sentenced in Superior Court

The following occurred during the Emanuel County Superior Court April 2024 term:

Frederick Anthony, repeat offender, negotiated a guilty-alford plea on one count interference with government property. He was fined $50 with 5 years probation; one count fleeing and eluding law enforcement with 12 months probation; one count driving w/suspended license with 12 months probation; one count obstruction of an officer with 12 months probation; one count stop sign violation with 12 months probation. Defendant is sentenced for a total of five years to be served on probation. The above sentence may be served on probation provided the defendant shall comply with the conditions of probation imposed by the Court as part of his sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a). The above sentence includes a behavior incentive date of 4/30/2027 in accordance with O.C.G.A. 17.10.1.

George Rodriguez, repeat offender, negotiated a guilty plea on one count burglary 2nd degree. He was fined $50 with 5 years probation, 120-180 days in PDC; one count criminal damage to property in 2nd degree with 5 years probation; one count criminal damage to property in 2nd degree with 5 years probation; one count entering auto with 5 years probation; one count entering auto with 5 years probation; one count entering auto with 5 years probation; one count battery with 12 months probation. Defendant is sentenced for a total of 20 years to be served on probation. Defendant is to receive credit for time served in custody from 1/4/24-5/8/24. The above sentence may be served on probation provided the defendant shall comply with the conditions of probation imposed by the Court as part of his sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Terry Boatwright, repeat offender, negotiated a guilty plea on one count possession of a schedule II substance. He was fined $50 with 3 years probation, RSAT susp. for inpatient rehab; one count DUI (less safe) with 12 months probation. Defendant is sentenced for a total of 3 years to be served on probation. The above sentence may be served on probation provided the defendant shall comply with the conditions of probation imposed by the Court as part of his sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c).

Benjamin Caraway, repeat offender negotiated a guilty plea on one count sale of meth. He was fined $1,000 with 30 years, 5 years to serve, bal. probation; one count sale of meth with 30 years, 5 years to serve, bal. probation. Defendant is sentenced for a total of 30 years, with the first 5 years to be served in confinement and the remainder to be served on probation. Defendant is to receive credit for time served in custody as determined by the custodian. The above sentence may be served on probation provided the defendant shall comply with the conditions of probation imposed by the Court as part of his sentence. Upon service of 5 years, the remainder of the sentence may be served on probation; PROVIDED, that the defendant shall comply with the conditions of probation imposed by the Court as part of this sentence. The Court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(c).

Moises Ruiz negotiated a guilty-alford plea on one count possession of cocaine. He was fined $50 with 3 years probation, enter and complete DRC; one count possession of meth with 3 years probation. Defendant is sentenced for a total of 6 years to be served on probation. Defendant is to receive credit for time served in custody from 3/12/24-5/15/24. The above sentence may be served on probation provided the defendant shall comply with the conditions of probation imposed by the Court as part of his sentence.
