NOTICE OF HEARING

Notice to the public is hereby given that on October 9, 2024, at 10:00 a.m., in the Superior Court of Emanuel County, at the courthouse in said county, a hearing will be held in the case of State of Georgia v. Emanuel County Public Facilities Authority and Emanuel County, Georgia, on the petition and complaint to validate the Emanuel County Public Facilities Authority Revenue Bonds (Emanuel County Projects), Series 2024, in the aggregate principal amount of $10,110,000 (the “Bonds”), which are authorized to be issued by a bond resolution adopted on September 16, 2024, by vote of a majority of the members of the Emanuel County Public Facilities Authority. Proceeds from the sale of said Bonds will be used to provide funds to: (i) finance the renovation, construction and equipping of two new governmental administrative buildings (the “Projects”), and (ii) pay the expenses to be incurred in connection with the issuance and delivery of the Bonds.

The Court will also adjudicate the valid and binding effect of the form of an intergovernmental lease contract, to be dated as of the date of issuance and delivery of the Bonds, between the Authority and Emanuel County, under which Emanuel County will make payments to the Authority for use of the Projects sufficient to pay, when due, the principal of and interest on the Bonds, which payments are pledged as security for the payment of the Bonds sought to be validated.

NO PERFORMANCE AUDIT OR PERFORMANCE REVIEW, WITHIN THE MEANING OF O.C.G.A. § 36-82-100 SHALL BE CONDUCTED WITH RESPECT TO THE BONDS TO BE ISSUED BY THE EMANUEL COUNTY PUBLIC FACILITIES AUTHORITY.

At said hearing, all persons having a right to be heard with respect to the Bonds and the security provided therefor, and with respect to the validation thereof, may be heard.
