NOTICE OF SALE UNDER POWER

STATE OF GEORGIA COUNTY OF EMANUEL

By virtue of the power of sale contained in that certain Deed to Secure Debt from

William E. Panick to Vidalia Federal Savings Bank, dated March 10, 2014, filed on March 18, 2014, and recorded in Deed Book 397, pages 409-412, in the Office of the Clerk of the Superior Court of Emanuel County, Georgia, which secured a promissory note from William E. Panick to Vidalia Federal Savings Bank in the original principal amount of $51,000.00, there will be sold at public outcry for cash to the highest bidder before the courthouse doors of said county between the legal hours of sale on August 4, 2026, the first Tuesday of August, 2026, by Vidalia Federal Savings Bank, as attorney-in-fact for William E. Panick, the following described property, to-wit:

TRACT 1: All that certain tract or parcel of land lying in the 1502nd G.M. District of Emanuel County, being better described as Parcel 42 and 43, containing one acre of land each, more or less, as shown on a plat prepared by Joe P. Davis, Reg. Land Surveyor No. 1436, dated June 12, 1986 and January 12, 1987.

TRACT 2: All that certain tract or parcel of land lying in the 1502nd G.M. District of Emanuel County, Georgia, containing 1.0 acre of land, more or less, and bounded, now or formerly, as follows: On the North, East, and West by lands of E.R. Bobby Collins, Jr.; and on the South for a distance of approximately 120’ by the northerly right-of-way of a 40’ road.

Said tract of land is more particularly described according to that certain map or plat of survey prepared by Joe P. Davis, Georgia Reg. Land Surveyor No. 1436, on the 12th day of January 1987, in Plat Book 13, page 369, and further designated upon said plat as being Lot #44.

Tract 3: All that certain tract or parcel of land, situate, lying and being in the 1502nd G.M. District of Emanuel County, Georgia, being known as Lot Number 45 and being more particularly described by plats of said lot prepared by Joe P. Davis, Surveyor, and recorded in Emanuel County Plat Book 13, pages 368, 665, and 666, which are by reference hereto made a part and parcel of this description.

Subject to all easements, restrictions, and right-of-ways of record.

The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured, thereby this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney’s fees, notice of intention to collect attorney’s fees having been given as provided by law.

A copy of this legal advertisement (Notice of Sale Under Power) which was sent to Forest Blade, the legal organ of Emanuel County, Georgia, has been mailed by certified mail, return receipt requested to Kelly L. Panick, as Executor of the Estate of William E. Panick, as required by Georgia law, O.C.G.A. §44-14-162.2.

The property will be sold as the property of the Estate of William E. Panick, subject to the following: (1) all prior restrictive covenants, easements, right-of-ways, or encumbrances; (2) all valid zoning ordinances; (3) matters which would be disclosed by an accurate survey of the property; and (4) all outstanding taxes, assessments, unpaid bills, charges, and expenses that constitute liens against the property, whether due and payable or not yet due and payable.

Vidalia Federal Savings Bank is the holder of the Note and Deed to Secure Debt to the property in accordance with O.C.G.A. §44-14-162.2. The person that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtors and his address is as follows: Hal Chesser, and he may be reached at the Vidalia Federal Savings Bank office, 300 Jackson Street, Vidalia, GA 30474, or by telephone at (912) 537-8805. The foregoing notwithstanding, nothing in O.C.G.A. 44-14-162.2 shall be construed to require Vidalia Federal Savings Bank to negotiate, amend, or modify the terms of the Deed to Secure Debt described herein.

The undersigned reserves the right to reject any and all bids, to continue the sale from day to day, and to withdraw said property from sale and subsequently to reoffer same in the event no reasonable bid is received and accepted.

To the best of the undersigned’s knowledge and belief, the party in possession is Estate of William E. Panick, tenants, or parties claiming under the aforementioned.

The sale will be conducted subject to (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) to final confirmation and audit of the status of the loan with the holder of the security deed, including but not limited to a determination that the loan was not reinstated prior to the foreclosure.
