TO: Unknown Persons Who May Have a Property Interest in Real Properties located in Emanuel County, Georgia known as 1) 81 Dye Road, Swainsboro, Georgia; 2) 97 Dye Road, Swainsboro, Georgia; and 3) Parcel 097 037.
Notice is hereby given pursuant to O.C.G.A. § 44-9-41(5) that on the 7th day of April, 2022, Crown Castle Towers LLC filed a First Amended Petition to Establish a Private Way Pursuant to O.C.G.A. Sections 44-9-40, et seq., or Alternatively, For Declaratory Judgment and Abatement of Private Nuisance in the Superior Court of Emanuel County, Georgia, Civil Action No. 21CV00216. The real properties subject to this proceeding over which Petitioner is seeking ingress, egress, and access is 1) 81 Dye Road, Swainsboro, Georgia; 2) 97 Dye Road, Swainsboro, Georgia; and 3) Parcel 097 037 (Emanual County, Georgia). The owners of 81 Dye Road, Swainsboro, Georgia are David Thompson and Mary Thompson, so far as the same is known. The owner of 97 Dye Road, Swainsboro, Georgia is Kenneth Cox, so far as the same is known. The owner Parcel 097 037 (Emanual County, Georgia) is Bobby Claxton, so far as the same is known. The easement to be condemned is shown as “Woods Road” on a Survey recorded at Plat Book 20, Page 84B in the Emanuel County, Georgia property records. The property to be condemned for the easement may involve real property in which you may claim an interest.
A hearing to show cause why the easement for private way should not be condemned will be set by the Court following the publication herein. Any Answer or Objection to the Petition should be filed with the Clerk of the Superior Court of Emanuel County in Civil Action No. 21CV00216 and served upon Petitioner’s attorney, Elizabeth B.
