LLOYD GEORGE PATRICK ESTATE PROPERTY NOTICE

TERMINATION OF RIGHT OF REDEMPTION

TO: Lloyd George Patrick Estate and any heir at law of the said Lloyd George Patrick Estate; and any person or entity having any right, title, or interest in or lien upon the following described property.

Take notice that:

The right to redeem the following described property, to wit:

All that tract or parcel of land lying, 1208th G.M. District of Emanuel County, Georgia, containing one acre, as shown on plat of survey dated May 4, 1977, made by Walter K. Maupin, Surveyor, which is recorded in the Office of Clerk, Emanuel Superior Court in Plat Book 8, page 644 to which reference is made as a part of this description. Said property is bounded now or formerly as follows: North by lands of Lavern Bynes; Northeast by lands of Lavern Bynes ; South by lands of Archie and Joann Brinson; and West by Cross and Green Road.

Said property is the same as that conveyed by Tax Sale Deed dated November 5, 2019 from Sandra S. Wright to Johnny James Smith, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book 489, page 377-378.

Emanuel County Tax Assessor's Map and Parcel No. 069 119.

Will expire and be forever foreclosed and barred on and after the 1st of January, 2021.

After advertisement on November 5, 2019, said property was sold to Johnny James Smith to satisfy a tax fifa in favor of The City of Swainsboro for the years of 2017 & 2018 against Lloyd George Patrick.

The tax deed to which this notice relates is dated November 5, 2019, and is recorded in the Office of the Clerk of the Superior Court of Emanuel County, Georgia, in Deed Book 489, page 377-378.

Said Emanuel County Tax Deed conveyed the rights therein to Johnny James Smith.

The property may be redeemed at any time before the 1st day of January, 2021, by payment of the redemption price as fixed and provided by law to the undersigned at the following address: Johnny James Smith, 74 Piney Grove Road, Midville, GA 30441.

COMPLAINT FOR FORFEITURE

COMES NOW THE STATE OF GEORGIA, by and through S. Hayward Altman, District Attorney for the Middle Judicial Circuit and files this complaint for forfeiture pursuant to the Official Code of Georgia Annotated 16-13-49(b) and 9-16-12 and shows the Court the following:

The property sought to be forfeited is described in the above-styled caption and is incorporated hereon by reference thereto (hereinafter “the defendant property”)

  1. The defendant property is presently in the custody of the Swainsboro Police Department and is located within the county, and is within the venue and subject to the jurisdiction of this Court.
  2. On June 3, 2020, members of the Swainsboro Police Department served outstanding arrest warrants upon Devin Dikes and Kasey Sikes. Present at the scene with Devin Sikes and Kasey Sikes. Present at the scene with Devin Sikes and Kasey Sikes was Jamie Hagin.
  3. As a result of the arrest of the Sikes, a search warrant was obtained for the vehicle of Kasey Sikes. The search revealed methamphetamine, plastic bags, and digital scales used to distribute illegal drugs.
  4. Furthermore, Jamie Hagin gave officers of the Swainsboro Police Department permission to search her Toyota Camry. A search the vehicle revealed a large amount of methamphetamine and United States Currency.
  5. As a result of the discovery of the methamphetamine the defendant cellular phones, camera, and United States Currency were seized.
  6. The defendant property is contraband and subject to forfeiture to the State of Georgia pursuant to the provisions of O.C.G.A. 16-13-49(b). in that the defendant property was directly or indirectly used or intended for use to facilitate the distribution of methamphetamine in violation of O.C.G.A. 16-13-30 et seq. and is proceeds derived or realized therefrom; and was found in close proximity to methamphetamines and other which is subject to forfeiture pursuant to the provisions of O.C.G.A 16-136-49(b).

  • That all purported owners and interest holders who are unknown, who reside out of state, who depart the state, who cannot after due diligence be found within the state, or who conceal themselves so as to avoid service, be-served by publication by publishing a notice of proceedings once per week for two consecutive weeks in the legal organ of the county in which this complaint is pending as provided by O.C.G.A. 9-16-12(b)(3):
  • That the Court hold a hearing within sixty(60) days of the service of this complaint as provided by O.C.G.A. 9-16-12(f):
  • That the court enter judgment on favor of the State of Georgia declaring the defendant property or any part thereof forfeited to the State of Georgia to the provisions of O.C.G.A. 16-13-49;
  • That the Court retain jurisdiction to direct the proper disposition and distribution of the forfeited property as provided by O.C.G.A. 9-16-19; and
  • That the State of Georgia be afforded such other relief and remedies as are available under law and for due process to enforce the forfeiture.
