Five sentenced in Superior Court

The following occurred during the Emanuel County Superior Court April 2022 term:

James Edward Betten Jr., a repeat offender as imposed, negotiated a plea of guilty (alford) on two counts aggravated assault, two counts possession of firearm during the commission of crime and one count possession of firearm by a convicted felon. One additional count involving cruelty to children – third degree was deemed nol pros. He was fined $50 and sentenced to 30 years probation, provided that Betten shall comply with the conditions of probation imposed by the court as part of this sentence. The court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Darrian James Worthen, a repeat offender as imposed, negotiated a plea of guilty on one count burglary – first degree (reduced to criminal txp) and one count aggravated assault (FV battery). He was fined $50 and sentenced to 5 years. The defendant is to receive credit for time served in custody as determined by the custodian. The court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Under an additional criminal action number, as a repeat offender as imposed, Worthen also negotiated a plea of guilty on one count possession of oxycodone, one count possession of firearm during commission of a felony and possession of firearm by a convicted felon. For this, Worthen was fined $500 sentenced to 35 years, with the first 10 years to be served in confinement and the remainder on probation, provided that the defendant shall comply with the conditions of probation as imposed by the court as part of this sentence. The court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Melody Nichole Dennis negotiated a plea of guilty (alford) on one count aggravated assault, one count obstruction of an officer and one count mutiny to penal inst. She was fined $50 and sentenced to 20 years, with the first three years to be served in confinement and the remainder on probation, provided that the defendant shall comply with the conditions of probation imposed by the court as part of this sentence.

Michael Kelly Miller negotiated a plea of guilty on one count aggravated assault. He was fined $50 and sentenced to 15 years probation.

Lavana Omega McCoy, a repeater offender as imposed, negotiated a plea of guilty (alford) on one count sale of meth. McCoy was fined $500 and sentenced to 30 years, with the first 5 years to be served in confinement and the remainder on probation, provide that the defendant shall comply with the conditions of probations imposed by the court as part of this sentence. The defendant is to receive credit for time served in custody from 11/08/2021. The court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).

Under an additional criminal action number, as a repeat offender as imposed, McCoy negotiated a plea of guilty (alford) one count possession of meth with intent and three counts possession of scheduled 1 controlled substance with intent. For this, McCoy was fined $500 and sentenced to 35 years, with the first five years to be served in confinement and the remainder on probation, provided that the defendant shall comply with the conditions of probation imposed by the court as part of this sentence. The court sentences the defendant as a recidivist under O.C.G.A. § 17-10-7(a).
