Under and by virtue of the power of sale contained in that certain Deed to Secure Debt from Kim Reese f/n/a Kim Swindle (the “Grantor”) to and in favor of Spivey State Bank (the “Grantee” or “Lender”) dated October 4, 2013, filed for record October 7, 2013 and recorded in Deed Book 392, Page 97, Emanuel County, Georgia records (the “Security Deed”); securing that certain Promissory Note from Kim L. All that tract or parcel of land lying, situate and being in the City of Swainsboro, 53rd G.M. District of Emanuel County, Georgia, designated as Lot 4 and the Eastern 15 feet of Lot 3 of Mrs. James B. Mason Subdivision, fronting a combined distance of 80 feet on
the Northern side of Curtis Street as shown on a plat of survey dated January 19, 1956, made by J.D. McLeod, Surveyor, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book DR, Page 525 to which reference is made as a part of this description. Said property is bounded now or formerly as follows: North by the lands of Benjamin Norbert and lands of Jane B. Barnes; East by lands of Eugene C. Cuyler; South by Curtis Street; and West by lands of Gay Nell Price Estate.
Said property is the same as that conveyed by a Warranty Deed dated October 4, 2013 from Laura Anne Kirby to Kim Reese f/n/a Kim Swindle, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book 392, Pages 95-96.
Said property is the same as that conveyed by Administrators Deed dated February 26, 1999 from John Kirby as Administrator of the Estate of Gaynell Price, John Kirby, Kim Swindle, Larry Dean Price and Deborah Gentry, all individually and as their interest may appear to Kim Swindle and Laura Anne Kirby, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book 124, Pages 457-458.

The indebtedness evidenced by the Note is due and payable and remains unpaid. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorney’s fees (notice of intention to collect attorney’s fees having been given), then to the payment of all sums secured by the Security Deed, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Security Deed. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements and other
matters of record that are prior to the Security Deed and to which the Security Deed is subject and to any unpaid city, county and state ad valorem or assessment relating to the Premises. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final audit and confirmation of the status of the loan with the holder of the Security Deed.
To the best of the undersigned’s knowledge and belief, the owner of the Premises is the Grantor and the party or parties in possession of the Premises is the Grantor or tenants of the Grantor.

ADVERTISEMENT FOR BIDS FOR CONSTRUCTION OF U.S. HIGHWAY 1 BYPASS PUMP STATION AND FORCE MAIN ALTERNATE ROUTE for the EMANUEL COUNTY DEVELOPMENT AUTHORITY EDA 04-79-07368
Sealed proposals will be received by the Emanuel County Development Authority at 102 South Main Street, Swainsboro, Georgia, 30401 until 2:00 p.m. local time, Tuesday, April 27, 2021 at which time and place they will be publicly opened and read. No submitted bid may be withdrawn after the scheduled closing time for receipt of bids for a period of 60 days.
All Bidders must have a State of Georgia Utility Contractor License and must employ a state “Utility Manager” certificate holder who will have oversight of all the work.
The work to be done consists of furnishing all materials, equipment and labor for the construction of:
Division One: Force Main
Construction of approximately 14,780 L.F. of 10-inch PVC and 1,222 L.F. of 10-inch ductile iron force main, 520 L.F. 16-inch steel casing by jack and bore, 13 combination vacuum and air release valve manholes with appurtenances and storm water monitoring. Time allotted for this work is 180 consecutive calendar days for substantial completion and 210 days for final completion.
Division Two: Sewage Pump Station
Construction of one (1) duplex raw sewage pump station and corrosion inhibitor system including site work, wetwell, piping, fencing, access drive, electrical, pumps, painting, and all appurtenances. Time allotted for this work is 240 consecutive calendar days for substantial completion and 270 days for final completion.
Proposals for the complete work in one or more general contracts shall be made on the proposal form provided and shall contain prices in words and figures for the work bid on.
The work to be performed under this contract (EDA 04-79-07368) is on a project partially funded with Federal funds from the U. S. Department of Commerce, Economic Development Administration and therefore is subject to Federal laws and regulations associated with that program. The work to be performed under this contract must also comply with all applicable federal, state, territorial, and local laws, and in particular, the federal public laws, Executive Orders, OMB Circular, and local requirements.
All proposals shall be accompanied by a Bid Bond drawn in favor of the Emanuel County Development Authority, in the amount of at least 5% of the lump sum bid for the complete work; such Bid Bond representing that the Bidder, if awarded the contract, will promptly enter into a contract and furnish Performance Bond and Payment Bond as provided by law and approved by the Attorney for the Emanuel County Development Authority. Each bond shall be equal to 100% of the contract amount. The Bid Bond shall be forfeited to the Emanuel County Development Authority as liquidated damages if the Bidder fails to execute the contract and provide Performance and Payment Bonds within 10 days after being notified that he has been awarded the contract.
Drawings and Specifications are open to public inspection at the office of the Emanuel County Development Authority and at the offices of Turnipseed Engineers in Augusta and Atlanta, Georgia.
Copies of the plans and specifications may be obtained from Turnipseed Engineers, 4210 Columbia Road, Building 3, Augusta, Georgia 30907, upon receipt of $225. Additional reduced drawings are available for $125.
Digital copies of the documents are not available.
Upon receipt of all documents in undamaged condition within 30 days after the date of opening of bids, half of the deposit will be refunded.
The difference between the deposit and the amount refunded represents the cost of reproduction. No refund will be made for documents received after 30 days or in damaged condition.
The Owner reserves the right to reject any or all bids and to waive informalities.
