GEORGIA, EMANUEL COUNTY NOTICE OF SALE UNDER POWER

Under and by virtue of the Power of Sale contained in a Security Deed given by BARRY FRED BRASWELL to THE GEO. D. WARTHEN BANK dated March 28, 2018, recorded in Deed Book 462, Pages 162-171, Emanuel County, Georgia Records, conveying the after described property to secure a note in the original principal amount of $23,865.14, and all extensions, renewals, modifications or substitutions, with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the Courthouse door of Emanuel County, Georgia, within the legal hours of sale on February 7th, 2023, the following described property:

All that tract or parcel of land lying, situate and being in the City of Adrian, 1748th G.M. District of Emanuel County, Georgia, containing 1.14 acres, fronting on the Western side of Georgia Highway 15 and 78 on the Northwestern side of W. Norris Street, as shown on a plat of survey dated January 2, 1982 made by Billy Flanders, Surveyor, which is recorded in the Office of Clerk, Emanuel Superior Court in Plat Book 11, page 52, to which reference is made as a part of this description. Said property is bounded now or formerly as follows: NORTHWEST by lands of Carmen L. Fagler and lands of Shawn Leviner Living Trust; EAST by Georgia Highway 15 and 78; and SOUTHEAST by W. Norris Street.

Said property is the same as that conveyed by an Executor’s Deed dated March 28, 2018, from E. W. Avery, as Executor of the Audrey Faye Avery Brantley Estate a/k/a Andrey Faye Brantley to Barry Fred Braswell, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book 462, pages 159-161.

Said property is the same as that conveyed by a Warranty Deed dated December 23, 1999, from Angus W. Gillis to Audrey Faye Brantley, which is recorded in the Office of Clerk, Emanuel Superior Court in Deed Book 138, page 57.

Said property is designated in 2018 by the Emanuel County Tax Assessors as Map and Parcel #AD2-020.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney’s fees (notice of intent to collect attorney’s fees having been given).

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The person who has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Kenneth A. Bibb at The Geo. D. Warthen Bank, 216 North Harris Street, Sandersville, Georgia 31082, (478) 552-6901.

To the best knowledge and belief of the undersigned, the party in possession of the property is Barry Fred Braswell, and/or tenant(s).

The sale will be conducted subject to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code.

Statements of qualifications and proposals are being requested from architectural firms with a strong record in successfully assisting local governments with the implementation of Community Development Block Grant (CDBG) programs. Responding firms should be technically qualified and licensed in the State of Georgia to provide these services. Plans are to contract for architectural preliminary design services required for a potential FY 2023 CDBG project, and, if funded, for architectural services for the implementation of the project. The purpose of the project is to provide construction of a new mental health building that is located within the county.

Information which should be submitted for our evaluation is as follows:

1)History of firm and resources

2)CDBG/EIP/RDF experience, including other DCA grant programs

3)Key personnel/qualifications

4)Current workload

5)Scope and level of service proposed

6)Experience with similar projects and list of references

7)Fees and/or Percentages (if any) associated with the Preliminary Architect Report (PAR) for the application, and Design and Construction Management Services, if the project is funded. The draft PAR would be needed no later than April 14, 2023

8)Errors and Omissions Insurance

9)Statement of Qualifications Form

10)Section 3 Certification Form (Only Submit with your Proposal if you are claiming Section 3 Status.)

All contracts are subject to Federal and State contract provisions prescribed by the Georgia Department of Community Affairs. This project is covered under the requirements of Section 3 of the HUD Act of 1968, as amended and Section 3 Business Concerns are encouraged to apply.

Emanuel County also abides by the following laws as they pertain to HUD Assisted Projects: Title VI of the Civil Rights Act of 1964; Section 109 of the Housing and Community Development Act of 1974, Title 1; Title VII of the Civil Rights Act of 1968 (Fair Housing Act); Section 104(b)(2) of the Housing and Community Development Act of 1974; Section 504 of the Rehabilitation Act of 1973 as amended; Title II of the Americans with Disabilities Act of 1990 (ADA); and the Architectural Barriers Act of 1968.

Interested parties should request copies of the Statement of Qualifications Form and Section 3 Solicitation Package prior to preparing and submitting their proposal. Proposals should be received no later than 5:00 PM on February 23, 2023, Proposals received after the above date and time may not be considered. We reserve the right to accept or reject any and all proposals and to waive informalities in the proposal process.
