You are hereby notified that the above-styled action has been brought by the Toombs County Department of Family and Children Services, and the Georgia Department of Human Services, seeking to terminate your parental rights with regard to the above-referenced children; that said action has been filed in the Juvenile Court of Toombs County, Georgia; and that by reason of an Order for Service of Summons by Publication dated October 29, 2019, you are hereby notified that you may obtain a copy of the petition from the Clerk of the Juvenile Court of Toombs County, Georgia and may file with the Clerk of said Court, and serve upon Jenifer T. McComas, Petitioner’s Attorney, whose mailing address is 128 Jackson Street, Vidalia, Georgia, 30474, an answer to the petition at any time prior to the Final Hearing.  You are hereby commanded and required to appear before this court on December 3, 2019 at the Toombs County Courthouse in Lyons, Georgia at 10:00 a.m., and show cause, if any you have, why the relief requested in the petition should not be granted.

The hearing scheduled above is a provisional hearing held pursuant to O.C.G.A. §1511163 and O.C. G.A. §15-11-282.  The final hearing in this matter is scheduled on January 7, 2020 at the Toombs County Courthouse in Lyons, Georgia, at 10:00 a.m.  You are hereby commanded and required to appear before this Court at said final hearing or pursuant to O.C.G.A. §1511163 and O.C. G.A. §15-11-282 the findings of the Court made at the provisional hearing will be made the permanent order of this Court in the above case.

Be advised if you fail to attend the provisional hearing, you must attend the final hearing in order to preserve your rights.  At the final hearing you will be given an opportunity to show cause, if any you have, why the relief requested in the petition should not be granted.

If you fail to appear, the court can terminate your parental rights in your absence.

Any biological father, known or unknown, is hereby notified that he will lose all rights to the children and will not be entitled to object to the termination of his rights to the children unless, within thirty days of receipt of this notice, he files:

(a) a petition to legitimate the children pursuant to O.C.G.A. §19-7-22; and

(b) notice of the filing of the petition to legitimate with the Toombs County Juvenile Court.

If the court at the trial finds that the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interests of your children, the court can enter a judgment ending your rights to your children.

If the judgment terminates your parental rights, you will no longer have any rights to your children.  This means that you will not have the right to visit, contact, or have custody of your child or make any decisions affecting your children or your children’s earnings or property.  Your children will be legally freed to be adopted by someone else.

Even if your parental rights are terminated:

(1) You will still be responsible for providing financial support (child support payments) for your child’s care unless and until your child is adopted; and

(2) Your child can still inherit from you unless and until your child is adopted.

This is a very serious matter.  You should contact an attorney immediately so that you can be prepared for the court hearing.  You have the right to hire an attorney and to have him or her represent you.  If you cannot afford to hire an attorney, the court will appoint an attorney if the court finds that you are an indigent person.  Whether or not you decide to hire an attorney, you have the right to attend the hearing of your case, to call witnesses on your behalf, and to question those witnesses brought against you.

CATEGORICAL EXCLUSION DETERMINATION

The Georgia Environmental Protection Division (EPD) has conducted a review of the above subject project in accordance with the State’s Environmental Review Process (SERP) for Drinking Water State Revolving Fund (DWSRF) projects. The EPD has determined that this project is eligible for a categorical exclusion. Accordingly, the EPD is exempting the project from further substantive environmental review requirements under Georgia’s SERP.

The proposed project involves dismantling an existing 100,000-gallon elevated drinking water tank and construct a new 500,000-gallon elevated drinking water tank on the existing 100,000-gallon tank site.

This project is eligible for a Categorical Exclusion because it meets the following specific criteria, outlined in the DWSRF SERP: Improvements to existing surface or ground water treatment plants, including improvements to enhance security, which do not add a significant change in treatment capacity. Furthermore:

The project will not require issuance of a new or modification of an existing ground water or surface water withdrawal permit;The project is not known or expected to have a significant adverse effect on the quality of the human environment, either individually, cumulatively over time, or in conjunction with other Federal, State, local orprivate actions;The project is not known or expected to directly or indirectly have a significant adverse effect on: or threatened species; or environmentally important natural resource areas, such as floodplains, wetlands, important farmlands or aquifer recharge areas; and cultural resource areas, such as archaeological and historic sites; habitats of endangered species; The action is cost-effective and is not expected to cause significant public controversy.

This determination shall become effective after thirty (30) days following its distribution by EPD and can be revoked if significant adverse information is made available. The documentation to support this decision is on file with the Georgia Environmental Protection Division and is available for public scrutiny upon request. A copy of the proposed project documentation is also available for review at the City Hall in Swainsboro, Georgia.

All interested agencies, groups and persons supporting or disagreeing with this decision are invited to submit written comments, within thirty (30) days of the publish date of this notice to:
