Because of a default under the terms of the Security Deed executed by Mitch Jackson to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Homeowners Mortgage Enterprises, Inc., its successors and assigns dated March 31, 2011, and recorded in Deed Book 352, Page 548, Emanuel County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $194,037.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 3, 2019, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: 

All that certain tract or parcel of land situate, lying and being in the 53rd G.M. Said property is more particularly described on that certain plat of survey prepared by Marlin Nevil, Registered Land Surveyor, dated September 15, 2004, and recorded in Plat Book 21, Page 393, Clerk’s Office Emanuel Superior Court. Said plat is incorporated herein and made a part hereof by reference.

Said property is known as 254 Trout Trail, Swainsboro, GA 30401, together with all fixtures and personal property attached to and constituting a part of said property, if any.

Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.

The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.

The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.

If the court at the trial finds that the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interests of your children, the court can enter a judgment ending your rights to your children.

If the judgment terminates your parental rights, you will no longer have any rights to your children.  This means that you will not have the right to visit, contact, or have custody of your child or make any decisions affecting your children or your children’s earnings or property.  Your children will be legally freed to be adopted by someone else.

Even if your parental rights are terminated:

(1) You will still be responsible for providing financial support (child support payments) for your child’s care unless and until your child is adopted; and

(2) Your child can still inherit from you unless and until your child is adopted.

This is a very serious matter.  You should contact an attorney immediately so that you can be prepared for the court hearing.  You have the right to hire an attorney and to have him or her represent you.  If you cannot afford to hire an attorney, the court will appoint an attorney if the court finds that you are an indigent person.  Whether or not you decide to hire an attorney, you have the right to attend the hearing of your case, to call witnesses on your behalf, and to question those witnesses brought against you.
