Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by KRISHAN JAYACHANDRA to DURDEN BANKING CO., INC. P.O. Box 160, Twin City, GA 30471,  dated July 11, 2007 and recorded in Deed Book 294, pages 362-366, Emanuel County, Georgia Records, conveying the after-described property, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Emanuel County, Georgia, within the legal hours of sale on the first Tuesday in July, 2018, to wit: July 3, 2018, the following described property:

Tract 1:  All that tract or parcel of land lying, situate and being in the 53rd G. M. District of Emanuel County, Georgia, containing 1.860 acres and designated as Parcel 2 as shown on plat of survey made by George William Donaldson, Surveyor, dated April 19, 2007, recorded in the Office of Clerk, Emanuel Superior Court, in Plat Book 21, page 676, to which reference is made as a part of this description.  Said 1.860 acres is bounded now or formerly as follows:  On the Northwest by lands of Linda Dekle Lamb; Northeast by Parcel 3, being lands of John M. Tract 2:  All that tract or parcel of land lying, situate and being in the 53rd G.M. District of Emanuel County, Georgia, containing 6.43 acres, more or less, as shown on a Plat of Survey by Walter K. Maupin, Registered Surveyor, dated October 14, 1982. Said plat is recorded in the Office of Clerk of the Superior Court of Emanuel County, Georgia, in Plat Book 11, page 164, and by express reference incorporated herein for a more full, complete and accurate description hereof.

Also a 20-foot easement as shown on said plat beginning at a concrete monument on the western right-of-way of Georgia Highway Number 56, running thence north-easterly 20 feet along the right-of-way of said Highway Number 56 to a point with the intersection of the right-of-way of Georgia Highway Number 56 and the estate of Mary L. Wimberly, thence turning and running 630.28 feet, more or less, as shown on said plat, in a northwesterly direction along the right-of-way of John M. Neighbors; thence turning and running southwesterly a distance of 80.3 feet as shown on said plat between parallel lines a distance of 20 feet apart along the right-of way of John M. Neighbors to Parcel Number 1.

This right-of-way easement shall be construed as a covenant running with the land which said right-of-way is granted and not merely an easement, and shall be binding not only upon the Grantor, but his/her/its successors in title and may be used not only by the Grantee but his/her/its successors in title.

The above described property is the same as that conveyed from Frederic R. Vautier to Krishan Jayachandra  by a Warranty Deed dated March 21, 2007, recorded in the Office of Clerk, Emanuel Superior Court, in Deed Book  287, pages 507-508.

Said Deed to Secure Debt was executed to secure a Note of even date in the original principal amount of $176,725.50, with interest at the rate specified therein together with all other indebtedness of the borrower to the lender then due or that might thereafter become due, or thereafter become contracted, which was or would be evidenced by a note or notes.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees. Notice of intent to collect attorney’s fees has been given, as provided by law.

Said property is commonly known as 41 Quail Lake Drive, Swainsboro, GA 30401, together with all fixtures and personal property attached to and constituting a part of said property. To the best knowledge and belief of the undersigned, the party in possession of the subject property is: KRISHAN JAYACHANDRA or tenant or tenants.

Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, and covenants, etc.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; (2) O.C.G.A. Section 9-13-172.1; and (3) final confirmation and audit of the status of the loan with the holder of the security deed.

Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.

ADVERTISEMENT FOR BIDS FOR CONSTRUCTION OF
SEWERAGE SYSTEM IMPROVEMENTS
EMANUEL COUNTY DEVELOPMENT AUTHORITY

Sealed proposals will be received by EMANUEL COUNTY DEVELOPMENT AUTHORITY at 102 South Main Street, Swainsboro, Georgia, 30401 until 2:00 P.M. local time, Thursday, July 19, 2018 at which time and place they will be publicly opened and read.  No submitted bid may be withdrawn after the scheduled closing time for receipt of bids for a period of sixty (60) days.

All Bidders must have a State of Georgia Utility Contractor License and must employ a state “Utility Manager” certificate holder who will have oversight of all the work.

Work to be done: The work to be done consists of furnishing all materials, equipment and labor for the construction of:

Division One:  Force Main

Construction of approximately 63,091 L.F. of 6-inch PVC force main and      2,939 L.F. of 6-inch fusible PVC force main by directional bore, 762 L.F. 12-inch steel casing by jack and bore, 12 combination air and vacuum release valves and manholes with appurtenances and storm water monitoring.  Time allotted for this work is 240 consecutive calendar days.

Division Two:  Sewage Pump Stations

Construction of three (3) duplex raw sewage pump stations and corrosion inhibitor systems including site work, wetwell, piping, fencing, access drive, electrical, pumps, painting, and all appurtenances.  Time allotted for this work is 240 consecutive calendar days.

Proposals for the complete work in one or more general contract(s) shall be made on the proposal forms provided and shall contain prices in words and figures.

All proposals shall be accompanied by a Bid Bond drawn in favor of EMANUEL COUNTY DEVELOPMENT AUTHORITY, in the amount of at least 10% of the lump sum bid for the complete work; such Bid Bond representing that the Bidder, if awarded the contract, will promptly enter into a contract and furnish Performance Bond and Payment Bond as provided by law and approved by the Attorney for EMANUEL COUNTY DEVELOPMENT AUTHORITY.  Each bond shall be equal to 100% of the contract amount.  The Bid Bond shall be forfeited to EMANUEL COUNTY DEVELOPMENT AUTHORITY as liquidated damages if the Bidder fails to execute the contract and provide Performance and Payment Bonds within ten (10) days after being notified that he has been awarded the contract.

If the court at the trial finds that the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interests of your children, the court enter a judgment ending your rights to your children. If the judgment terminates your parental rights, you will no longer have any rights your  children. This means that you will not have the right to visit, contact, or have custody of your child or make ant decisions affecting your children or your children’s earning or property. Your children will be legally freed to be adopted by someone else.

Even if your parental rights are terminated:

(1) You will still be responsible for providing financial support (child support payments) for your child’s care unless and until your child os adopted; and

(2) Your child can still inherit from you unless and until your child is adopted.

This is a very serious matter. You should contact an attorney immediately so that you can be prepared for the court hearing. You have the right to hire an attorney and to have him or her represent you.

If you cannot afford to hire an attorney, the court will appoint an attorney if the court finds that you are an indigent person. Whether or not you decide to hire an attorney, you have the right to attend the hearing of your case, to call witnesses on your behalf, and to question those witnesses brought against you.
