This being the same tract or parcel of land deeded in a Warranty Deed from Mable C. Johnson and Annie Mae B. Chance, as Grantors, to James Chance, Doris Ruffin, Lessie Bell C. Lester, James L. Cowart, Ruby Williams, Naomi Johnson, Wilhelmina Cheeseborough, Mary L. Tutson, Edward Williams, Woodie Celestine Johnson, and Ruby Aretha Williams, as Executrix of the Last Will and Testament of Clifford J. Chance, as Grantees dated February 21, 1984 and recorded in Deed Book IH, Pages 756-757 in the Office of the Superior Court of Emanuel County, Georgia.  LESS AND EXCEPT: Two tracts cut therefrom, to wit: 13.88 acres as shown by Plat made by George William Donaldson, Surveyor, dated August 28, 1980, which is recorded in said records in Plat Book 23, Page 6, and a separate tract of 15.43 acres, as shown on a Plat made by Walter K. Bailey by Executrix Deed from Eloise Bailey as Executrix of the Last Will and Testament of Wallace C. Bailey, which was dated December 26, 1985. Said Deed is recorded i Deed Book IS, pages 307-308 of the Records of the Office of the Clerk, Emanuel Superior Court. Eloise S. Bailey died September 3, 2002, leaving title to said property vested solely in Rebecca J. Bailey.

Said Deed to Secure Debt was executed to secure a Note of even date in the original principal amount of $55,891.63, with interest at the rate specified therein together with all other indebtedness of the borrower to the lender then due or that might thereafter become due, or thereafter become contracted, which was or would be evidenced by a note or notes.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees. Notice of intent to collect attorney’s fees has been given, as provided by law.

Said property is commonly known as 2152 Highway 56, North, Midville, GA 30442, together with all fixtures and personal property attached to and constituting a part of said property. To the best knowledge and belief of the undersigned, the party in possession of the subject property is: WALLACE J. MOORE a/k/a WALLACE MOORE or tenant or tenants.

Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, and covenants, etc.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; (2) O.C.G.A. Section 9-13-172.1; and (3) final confirmation and audit of the status of the loan with the holder of the security deed.

Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.

Early Notice and Public Review of a Proposed

Activity in a 100-Year Floodplain and Wetland

To:  All interested Agencies EPD, DNR, FEMA, GDOT and Individuals

This is to give notice that Emanuel  County under Part 58 has determined that the following proposed action under the Revolving Loan Fund and is located in the 100-year floodplain and wetland, and Emanuel  County will be identifying and evaluating practicable alternatives to locating the action in the floodplain and wetland and the potential impacts on the floodplain and wetland from the proposed action, as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. Emanuel County is addressing the County’s need to serve the Highway 297 Industrial Park with water and sewer. There is a 100-year flood zone A and AE that crosses Old Nunez Road. Wetlands also cross old Nunez Road. A wetland delineation has been performed by Geotechnical and Environmental Consultants. Delineated areas will be avoided as much as feasible. Any areas requiring encroachment will be submitted to the Army Corp. along with drawings and other permitting data. The proposed project is located on Old Nunez Road and Highway 297 in Emanuel County.

There are three primary purposes for this notice. First, people who may be affected by activities in floodplain and wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Commenter’s are encouraged to offer alternative sites outside of the floodplain and wetland, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain and wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain and wetland, it must inform those who may be put at greater or continued risk.
