Final Notice and Public Explanation of a Proposed Activity in a 100-Year Floodplain and Wetland
To: All interested Agencies EPD, DNR, FEMA, GDOT and Individuals
This is to give notice that Emanuel County under Part 58 has conducted an evaluation as required by Executive Order 11990 and/or 11988, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Wetlands Protection. The activity is funded under the Revolving Loan Fund. The proposed project is located on Old Nunez Road/Highway 297 at the Emanuel County Industrial Park in Emanuel County. Emanuel County is addressing the access road, water and sewer connection to the industrial park. There is a 100-year flood zone A, AE and wetlands located in the project area. A wetland delineation has been performed by Geotechnical and Environmental Consultants. Delineated areas will be avoided as must as feasible. Any areas requirement encroachment will be submitted to the Army Corp. along with drawings and other permitting data.
Emanuel County has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values.
Alternatives and Recommended Improvements:
Connecting to the Nunez Water System – The City of Nunez has a very small water system and not capable of meeting the long term needs of the park; therefore, this alternative was not considered further.
Construction an Onsite Well and Water Tank – The construction cost for constructing a well onsite and a 250,000 gallon elevated water tank is approximately $985,000
Installing a Water Line and Connecting to the City of Swainsboro Water System – The third alternative to install a water line and connect to the City of Swainsboro has a construction cost of approximately $271,400.
The City of Nunez does not have a sewage system.
Installation of a Septic System – Septic systems are typically installed for low volumes of wastewater. A septic system will not meet the needs of the park for the long term; therefore, the cost for a septic system is not included in the report.
Constructing a Pump Station Onsite and Installing a Force Main to the City of Swainsboro – The City of Swainsboro has capacity to receive additional sewage flows from the park and is the closest system capable of receiving and treating the sewage. Due to the timing of funding and improvements scheduling, a septic tank may be required initially for the Sawmill until the proposed sewerage system improvements are complete.
Road/Deceleration Lane Improvements
Installing a Roundabout – This alternative is not warranted due to low traffic volume on Highway 297 and the park.
Installing a Red light – This alternative is not warranted due to low traffic volume on Highway 297 and the park.
No Action Alternative: The “No Action Plan” would mean that the Sawmill would not be served with water or sewer infrastructure. So therefore the industry could not operate. Also other potential industries would not want to locate in this industrial park.
Please refer to the environmental report located at Emanuel County Board of Commissioners Office located at 101 North Main Street, Swainsboro, GA 30401 for a copy of the submissions and responses received from different agencies regarding the mitigation measures.
Emanuel County has reevaluated the alternatives to construct in the floodplain and wetland and has determined that it has no practicable alternative. Environmental files that document compliance with steps 3 through 6 of Executive Order 11990 and/or 11988, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments.
There are three primary purposes for this notice. First, people who may be affected by activities in floodplain and wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain and wetland can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain and wetland, it must inform those who may be put at greater or continued risk.

On or about May 11, 2018 Emanuel County will submit a request to the Georgia Department of Community Affairs for the release of Community Development Block Grant/Revolving Loan Funds under Section 109 Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake a project known as the Emanuel County Highway 297 Industrial Park to serve the industries that have or will be locating in the park with and access road and water and sewer services. The estimated funding for this project is $944,000.
FINDING OF NO SIGNIFICANT IMPACT
Emanuel County has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Emanuel County Development Authority 102 South Main Street, Swainsboro, GA 30401 and Associates in Local Government Assistance, Inc., 1007 W. 12th Street, Alma, GA 31510 and may be examined or copied weekdays 8:00A.M to 5:00P.M.
Any individual, group, or agency may submit written comments on the ERR to Emanuel County Development Authority 102 South Main Street, Swainsboro, GA 30401. All comments received by May 10, 2018 will be considered by Emanuel County prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
Emanuel County certifies to DCA that Keith Thompson in his capacity as Chairman consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. DCA’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Emanuel County to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
DCA will accept objections to its release of fund and Emanuel County certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of Emanuel County; (b) Emanuel County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by DCA; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to DCA at 60 Executive Park South, N.E., Atlanta, GA 30329.
