Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by MELISSA M. COKER to THOMAS B. GARRETT, dated July 15, 2005 and recorded in Deed Book 251, pages 304-307 and a Corrective Deed to Secure Debt given by MELISSA G. COKER to THOMAS B. GARRETT, dated July 15, 2005 and recorded in Deed Book 252, pages 223-226, Emanuel County, Georgia Records, conveying the after-described property, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Emanuel County, Georgia, within the legal hours of sale on the first Tuesday in October, 2017, to wit: October 3, 2017, the following described property:

All that tract or parcel of land lying, situate and being in the 53rd G.M. District of Emanuel County, Georgia, designated as Lot #1, Block B of DeLoach Subdivision, containing 2.30 acres, as shown on a plat of survey dated May 3, 1976 made by Walter K. Maupin, Surveyor, which is recorded in the Office of Clerk, Emanuel Superior Court in Plat Book 8, page 672, to which reference is made as a part of this description. Said Deed to Secure Debt was executed to secure a Note of even date in the original principal amount of $104,363.28, with interest at the rate specified therein together with all other indebtedness of the borrower to the lender then due or that might thereafter become due, or thereafter become contracted, which was or would be evidenced by a note or notes.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney’s fees. Notice of intent to collect attorney’s fees has been given, as provided by law.

Said property is commonly known as 42 Phillips Street, Swainsboro, GA 30401, together with all fixtures and personal property attached to and constituting a part of said property. To the best knowledge and belief of the undersigned, the party in possession of the subject property is: Melissa G. Coker or tenant or tenants.

Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, and covenants, etc.

The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; (2) O.C.G.A. Section 9-13-172.1; and (3) final confirmation and audit of the status of the loan with the holder of the security deed.

Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.

Emergency Food and Shelter Grant Received

Emanuel County has been awarded federal funds made available through the department of homeland security (DHS) /federal emergency management agency under the emergency food and shelter national board program.

Emanuel County has been chosen to receive $12,487 to supplement emergency food and shelter programs in the county.

The selection was made by a National Board that is chaired by the U. S. Department of Homeland Security’s Federal Emergency Management Agency and consists of representatives from American Red Cross; Catholic Charities, USA; National Council of the Churches of Christ in the USA; The Jewish Federations of North America, The Salvation Army; and, United Way Worldwide. The Local Board was charged to distribute funds appropriated by Congress to help expand the capacity of food and shelter programs in high-need areas around the country. A Local Board will determine how the funds awarded are to be distributed among the emergency food and shelter programs run by local service agencies in the Emanuel County area. The Local Board is responsible for recommending agencies to receive these funds and any additional funds made available under phase 34 of the program. In previous phases of this program these funds have been used primarily to provide food and shelter to the needy within the County.

   Under the terms of the grant from the National Board, local agencies chosen to receive funds must: 1) be private voluntary non-profits or units of government, 2) be eligible to receive Federal funds, 3) have an accounting system, 4) practice nondiscrimination, 5) have demonstrated the capability to deliver emergency food and/or shelter programs, and 6) if they are a private voluntary organization, have a voluntary board. Qualifying agencies are urged to apply.

Public or private voluntary agencies interested in applying for Emergency Food and Shelter Program funds must contact Tammy Jackson at 706.736.1199 x 218 or email tjackson@goldenharvest.org   for an application. The deadline for applications to be received is September 22, 2017

Public Input Requested for the State of Georgia’s

Draft Consolidated Annual Performance and Evaluation Report (CAPER) FFY2016/ SFY2017

The State of Georgia, in compliance with applicable U.S. Department of Housing and Urban Development (HUD) regulations, has prepared a draft version of the State’s Consolidated Annual Performance and Evaluation Report (CAPER) for the Federal Fiscal Year 2016.  The CAPER is the annual review of the State’s performance in meeting the goals and objectives identified in the 2013-2017 Consolidated Plan and FY 2016 Annual Action Plan.  Note that the CAPER also includes the State CDBG Performance and Evaluation Report (State PER) for the State of Georgia Community Development Block Grant (CDBG) Program. The State of Georgia encourages citizens, public agencies and other interested parties to review the contents of its draft CAPER and to submit their written comments..  Note that for the State of Georgia Community Development Block Grant (CDBG) Program, the CAPER also includes the State CDBG Performance and Evaluation Report (State PER). The State PER is also available as described below and citizens, public agencies and other interested parties are encouraged to review the contents of the draft State PER and to submit written comments.
