NOTICE OF

REFERENDUM TO AUTHORIZE THE PACKAGE SALES BY RETAILERS OF MAL BEVERAGES, WINE, AND DISTILLED SPIRITS ON SUNDAYS BETWEEN THE HOURS OF 12:30 P.M. AND 11:30 P.M. IN THE CITY OF SUMMERTOWN, GEORGIA ON NOVEMBER 6, 2012

Pursuant to a resolution adopted on July 3, 2012, by the City Council for the City of Summertown (“Summertown”), the managing and controlling body of the City of Summertown, Georgia, and a call of election issued by the Board of Elections of Emanuel County, as Election Superintendent, notice is hereby given as follows:

1. On November 6, 2012, an election will be held in Summertown to submit to the qualified voters of Summertown the following question:

( ) NO

Shall the governing authority of Summertown, Georgia be authorized to permit and regulate package sales by retailers of malt beverages, wine and distilled spirits on Sundays between the hours of 12:30 P.M. and 11:30P.M.?

2. All qualified voters desiring to vote in favor of authorizing the sales by retailers of malt beverages, wine and distilled spirits on Sundays between the hours of 12:30P.M and 11:30 P.M. shall vote “Yes” and all qualified voters opposed shall vote “No.” If more than one-half of the votes cast are in favor, the City Council shall be authorized on December 4, 2012, to adopt an ordinance which provides the terms and conditions for the package sale by retailers of malt beverages, wine, and distilled spirits on Sundays between the hours of 12:30 P.M. and 11:30 P.M.

3. The last day to register to vote in the election is Tuesday, October 8, 2012. Anyone desiring to register may do so by applying in person at the voter registration office located at 105 South Main Street, Swainsboro, Georgia, or by any other method authorized by the Georgia Election Code.

4. The election will be held on Tuesday, November 6, 2012. The polls will be open from 7:00 a.m. until 7:00 p.m.

NOTICE OF FORECLOSURE

GEORGIA, EMANUEL COUNTY.

WHEREAS, heretofore on November 11, 2009, BEN F. HOWELL and LISA F. HOWELL did execute and deliver to THOMAS E. ROUNTREE and VELMA DORIS ROUNTREE of the County of Emanuel, State of Georgia, a Deed to Secure Debt conveying the land described in Schedule “A” below; And,

WHEREAS, said Deed to Secure Debt was executed to secure a Note of even date therewith in the original amount of THIRTY THREE THOUSAND NINE HUNDRED AND NO/100 ($33,900.00) DOLLARS together with all other indebtedness of the Borrowers to the Lender then due or that might thereafter become due, or thereafter contracted, including any renewals thereof which was or would be evidenced by the Note or Notes from BEN F. HOWELL and LISA F. HOWELL to THOMAS E. ROUNTREE and VELMA DORIS ROUNTREE, all of which is shown by said Deed to Secure Debt recorded in the Office of Clerk, Emanuel County Superior Court, in Deed Book 332 Pages  347-352; And,

WHEREAS, said Note and Deed to Secure Debt as described therein, which were due and payable in monthly installments are past due and BEN F. HOWELL and LISA F. HOWELL, have been notified that the mortgage is in default and that the lender(s) therein have elected to accelerate payment of said Note; And,  

WHEREAS, notice has been given to BEN F. HOWELL and LISA F. HOWELL as required by O.C.G.A. 44-14-162 through 44-14-163.4 (MICHIE 1982).

NOW THEREFORE, according to the terms of said Deed to Secure Debt and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash, the property described in said Deed to Secure Debt from after proper advertisement, on the first Tuesday in November, 2012, to-wit: November 6, 2012, between the legal hours of sale before the courthouse door in Emanuel County, Georgia.  Said sale will be subject to any outstanding ad valorem taxes, and the purchaser will be responsible for any Georgia Real Estate Transfer Tax.  Proceeds from said sale will be used first, to pay the cost and expense of said sale; second, to pay the balance on the indebtedness mentioned above due by BEN F. HOWELL and LISA F. HOWELL to THOMAS E. ROUNTREE and VELMA DORIS ROUNTREE, and third, to pay the surplus, if any, to the person or persons legally entitled thereto.

Provides for improving student achievement and parental involvement through more public charter school options.

Shall the Constitution of Georgia be amended to allow state or local approval of public charter schools upon the request of local communities?”

This proposal authorizes the General Assembly to provide by law for the creation of public state charter schools, which would operate under the terms of charters between the State Board of Education and charter petitioners, while preserving the authority of local boards of education to establish local charter schools.  Specifically, the proposal clarifies the authority of the General Assembly to provide for state?wide policies for public education prior to the college or post?secondary level, restates the authority of the General Assembly to establish special schools, prohibits the incurrence of bonded indebtedness or the levy of school taxes for the support of special schools without approval of the local board of education and the voters in the affected school system, provides that special schools may 

include public state charter schools, preserves the authority of local boards of education to establish local charter schools, authorizes the expenditure of state funds for special schools, and prohibits the deduction of certain state funds from local school districts as a direct result or consequence of the enrollment of students in state charter schools.

The General Assembly has enacted a law to exercise the authority granted by the proposed constitutional amendment to provide for public state charter schools.  This law will become effective only if the constitutional amendment is ratified by the voters.  This law is published at Georgia Laws 2012, p. 1298, Sec. 1, and was enacted by 2012 HB 797, Act No. 766.

Allows the state to save taxpayer funds through multiyear real estate rental agreements.

Senate Resolution No. 84 

Ga. L. 2012, p. 1363 

“(  ) YESShall the Constitution

  (  ) NOof Georgia be amended so as to provide for a reduction in the state’s operating costs by allowing the General Assembly to authorize certain state agencies to enter into multiyear rental agreements?”

GNSThis proposal authorizes the General Assembly to provide by law for the State Properties Commission, the Board of Regents of the University System of Georgia, and the Georgia Department of Labor to enter into rental agreements for the possession and use of real property without obligating present funds for the full amount of obligation the state may bear under the full term of any such rental agreement.  Any such agreement shall provide for the termination of the agreement in the event of insufficient funds.

The General Assembly has enacted a law to exercise the authority granted by the proposed constitutional amendment to provide for multiyear rental agreements for real property.  This law will become effective only if the constitutional amendment is ratified by the voters.  This law is published at Georgia Laws 2012, p. 989, and was enacted by 2012 SB 37, Act No. 717.
