virtue of the power of sale contained in a Deed to Secure Debt by

Willie Joe Hughes  to Mortgage Electronic Registration Systems,

Inc. (“MERS”) as nominee for U.S. Mortgage Corp, dated October 9,

2007 and filed for record October 12, 2007 in Deed Book 299, Page

320, Emanuel County, Georgia records, and securing a Note in the

original principal amount of $59,050.00; last transferred to

CitiMortgage, Inc. by Assignment filed for record February 1, 2011

in Deed Book 349, Page 592, Emanuel County, Georgia records, there

will be sold at a public outcry for cash to the highest bidder

before the Courthouse door of Emanuel County, Georgia, between the

legal hours of sale on the first Tuesday in December, 2011, by

THAT TRACT or parcel of land lying, situate and being in the 1560th

GM District of Emanuel County, Georgia, containing 4.18 acres, more

or less, and bounded now or formerly as follows:   north by lands

of Kenneth Bryan Mercer; east by lands of Kenneth Bryan Mercer;

south by lands of Randy J. Ellison and Wanda Ellison; and west by

INCLUDED IN SAID property is a one-acre lot of land shown on a plat

and recorded in the Office of the Clerk, Emanuel Superior Court, in

Plat Book 6, Page 217, to which reference is made as a part of this

description.  Said one tract is also described in a Quit Claim Deed

from the United States of America, acting through Farmers Home

Administration, to James A. Cowart dated November 17, 1982 and

recorded in Emanuel County Records in Deed Book IB, Pages 299-300. 

Said 4.18 acres, more or less, is a portion of a 62.1 acre tract of

land conveyed to James A. Cowart by a deed from A.L. Bell dated

October 5, 1955 and recorded in Deed Book DP, Page 564.

The above described property is also known as 7 Lee Lane,

Garfield, GA 30425.

The

indebtedness secured by said Deed to Secure Debt having been

declared due and payable because of default in the payment of the

indebtedness secured thereby, this sale will be made for the

purpose of paying the same and all expenses of sale, including

attorney’s fees, if applicable.

The

property will be sold as the property of the aforesaid grantor

subject to the following:  all prior restrictive covenants,

easements, rights-of-way, security deeds, or encumbrances of

record;  all valid zoning ordinances;  matters which would be

disclosed by an accurate survey of the property or by any

inspection of the property;  all outstanding taxes, assessments,

unpaid bills, charges, and expenses that are a lien against the

property whether due and payable or not yet due and payable.
