By virtue of a Power of Sale contained in that certain Security Deed from Phillip S. Jones, Jr. to The Central Bank, Swainsboro, dated February 22, 1991, recorded February 27, 1991, in Deed Book 28, Page 232, and modified at Deed Book 227, Page 244, Emanuel County, Georgia Records, said Security Deed having been given to secure a Note of even date in the original principal amount of TWENTY TWO THOUSAND SEVEN HUNDRED SEVENTY SIX AND 93/100 DOLLARS ($22,776.93), with interest thereon as provided for therein, said Security Deed having been last sold, assigned and transferred to Branch Banking and Trust Company, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Emanuel County, Georgia, within the legal hours of sale on the first Tuesday in January, 2007, all property described in said Security Deed including but not limited to the following described property:

IN DEED TO SECURE DEBT

COUNTY OF EMANUEL *

On the 26th day of August 2002, TONY M. TILLMON, (“Tillmon”) executed a Note and Deed to Secure Debt for $241,812.00 payable to Jim Walter Homes, Inc., conveying property described in Exhibit “A” attached, and recorded in the Office of the Clerk of Superior Court of Emanuel County, Georgia, in Deed Book 187, Page 633. Said Note and Deed to Secure Debt were subsequently assigned to Walter Mortgage Company, (“Walter”) by assignment dated October 10, 2006, and recorded in aforesaid Clerk’s Office.

Default has been made in the installment payments due for January 2006, and subsequent thereto. Walter declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid.

The Deed to Secure Debt provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Emanuel County, Georgia, upon Walter first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff’s advertisements are published, and where said property is located.

NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Emanuel County, Georgia, at public outcry on the first Tuesday in January 2007, between the legal hours of sale.

Take notice that:

The right to redeem the following described property, to wit:

All that tract or parcel of land located in the 1333rd G.M. District of Emanuel County, Georgia, known as Parcel 3 of the Frances Lovett Estate, containing 9.23 acres, more or less, as shown by that certain plat of survey prepared by Walter K. Maupin, dated March 31, 1983, and recorded in Plat Book 12, Page 133, Emanuel County Clerk’s records, which plat is hereby incorporated and made a part of this description by reference thereto. Said land being now or formerly bounded on the North by lands of Shirley B. Crawford and Parcel #4 of the Frances Lovett Estate; on the East by lands of Shirley B. Crawford; on the South by a county maintained road; and on the West by Parcel #2 of said estate. Said property is identified by the Emanuel County Tax Assessors Office as Map 161, Parcel 026;

will expire and be forever foreclosed and barred on and after 6th day of February, 2007.

The tax deed to which this notice relates is dated the 6th day of December, 2005, and is recorded in the office of the Clerk of the Superior Court of Emanuel, County, Georgia, in Deed Book 259 at pages 386-392.
