The indebtedness secured by said Deed to Secure Debt having been declared due and payable because of default in the payment of the indebtedness secured thereby, this sale will be made for the purposes of paying the same and all expenses of sale, including attorney’s fees, (notice having been given as provided by law).

The property will be sold as the property of The Aforesaid Grantors subject to the following:

WHEREAS, on June 6, 1986, for value received, Jimmie L. Leverett executed and delivered to the United States of America, acting through the United States Department of Agriculture, a Deed to Secure Debt conveying certain real estate located in Emanuel County, Georgia, and said Deed to Secure Debt was record ed in the Office of the Clerk of the Superior Court for Emanuel County, Georgia, in Book # IV, Page # 302-305; and

WHEREAS, on October 2, 2003, for value received, the subject loan was assumed by an Assumption Agreement by: Shelia Leverett; and

WHEREAS, the United States of America now holds the above described security deed covering the said real estate; and

WHEREAS, the Deed to Secure Debt held by the United States of America provides that should default occur, the holder may declare the entire indebtedness secured by the Deed to Secure Debt due and payable and, in compliance with the power of sale provisions contained in said security deed proceed to sell the property at public outcry; and

Notice to the public is hereby given that on November 9, 2005, at 10:00 o’clock a.m. in the Superior Court of Emanuel County, at the courthouse in said county, a hearing will be held in the case of the State of Georgia v. Emanuel County, on the petition to validate the Emanuel County General Obligation Sales Tax Bond, Series 2005, in the principal amount of $8,765,000 which is to be issued in accordance with a bond resolution adopted on October 17, 2005 by the Board of Commissioners of Emanuel County, pursuant to authorization given by the voters of Emanuel County voting in an election held on September 20, 2005 on the question of whether or not to reimpose a special county one percent sales and use tax in Emanuel County for the raising of an estimated $14,953,364 for the purpose of funding capital outlay projects of Emanuel County and the City of Adrian, the City of Garfield, the City of Nunez, the City of Oak Park, the City of Stillmore, the City of Summertown, the City of Swainsboro, and the City of Twin City. The approval by the voters also constituted approval of the issuance of general obligation debt of Emanuel County in the maximum principal amount of $8,765,000 for the purpose of financing the capital outlay projects of Emanuel County and the City of Swainsboro.

At said hearing all persons having a right to be heard with respect to the bond and the validation thereof and all other issues to be presented to the court in accordance with the petition filed, may be heard.
